Dear Sophie:

We are spending hard time filling vacant engineering and other positions in our company and are planning to make more concerted efforts to recruit internationally.

Do you have suggestions for attracting workers from abroad?

Dear Proactive,

Yes, I have many suggestions as to what you can do to support international talents interested in moving to the United States. Immigration is a great benefit for attracting the best and talented team members from all over the world. And providing immigration protection through visa practices and green card programs supports retaining these valuable individuals. Consider sponsoring international students and other qualified candidates in the upcoming H-1B lottery in March.

As it stands now, this year’s H-1B lottery will be random, not pay-to-play. We expect the electronic lottery process to follow these dates:

  • On March 9, 9 am PST: H-1B registration process opens.
  • On March 25 at 9 am PDT: H-1B registration process stopped.
  • March 31: You will find out whether your H-1B beneficiaries were selected electronically in this initial round of lottery.
  • April 1: 10/1/2021 or later, the first date of filing the selected H-1B in the lottery to request to begin.
  • 30 June: Last anticipated day of completion of selected H-1B petitions in this opening round of lottery.
  • After June 30: The possibility of a second lottery for registration submitted in March.

Through H-1B and other proactive immigration-assistance measures, you will enjoy greater understanding of immigration security to your international team members. This allows them to focus on their jobs instead of worrying about their immigration status. Here are my recommendations for attracting international talent from abroad and promoting productivity and loyalty.

Establish your company’s immigration policy

I recommend working with an experienced immigration lawyer who can help your company develop an immigration policy based on your company’s core values, recruitment and immigration budget and development plan. When recruiting top talent, consider immigration a benefit and a way to differentiate your company from others. Providing immigration benefits and immigration protection goes a long way towards building team member loyalty and longevity.

For some companies, the best policy may not be a policy, but it is important to deliberate about it and how it will affect your ability to make decisions and budget. For other companies, they implement a limited immigration policy, for example, appoint 40 engineers as soon as possible. Even with a decentralized workforce, a new recruit may be happy to relocate from Ukraine to Idaho, even if your company is not based there.
